01Agreement and eligibility

By using CalmSky, you agree to these Terms. If you do not agree, do not use the app. The purchase terms displayed by Apple App Store or Google Play also apply to purchases made through that store. Nothing in these Terms removes mandatory rights you have under applicable law.

CalmSky is intended for users aged 16 and over. You must be at least 16 to use it. If you are below the age at which you can enter a binding contract in your country, a parent or legal guardian must review and agree to these Terms and authorize any purchase. The app does not verify age through registration or an age gate; a store content rating does not replace these eligibility requirements.

02What CalmSky provides

CalmSky provides self-guided wellbeing activities for people who feel anxious about flying. The app download and Single Circle Breathing activity are free. The free activity presents grounding messages followed by six guided breathing rounds, each with a four-second inhale and a six-second exhale, without a hold.

Calming Facts requires an active subscription where subscriptions are available. It lets you select one of seven flying concerns and view short information cards, with simple diagrams where helpful. Essential free exercise content runs on your device; subscription access is checked through RevenueCat.

Exercises labeled Coming Soon are not available and are not unlocked by a subscription. No release date is promised. Buy a subscription only for the features described as available at the time of purchase.

CalmSky requires no user account, login or profile. Your store account and RevenueCat subscription records support paid access and purchase restoration. Availability can depend on your device, app version, store and country.

03Wellbeing and safe use

CalmSky provides general wellbeing support and educational information. It does not diagnose, treat, cure or prevent a medical or mental-health condition, and it is not a substitute for professional advice or care. It does not predict flight safety, turbulence or personal health outcomes, and it does not guarantee that an exercise will reduce anxiety.

Use exercises only when you can do so comfortably and safely. Stop an exercise if it makes you feel unwell. If you feel physically unwell during a flight, tell cabin crew and seek appropriate help. In an emergency, contact local emergency services or cabin crew; CalmSky is not an emergency service.

Always follow crew instructions and airline rules on device use. General information in CalmSky does not override instructions for your flight. Do not use the app while driving or performing another task that requires your full attention.

04Permission to use the app

Subject to these Terms and applicable store rules, we give you a limited, personal, non-exclusive and non-transferable license to use CalmSky for your own non-commercial purposes. Paid features require a valid entitlement. The app, text, illustrations, exercise designs and other content remain the property of their respective owners; no ownership is transferred to you.

You must not copy, sell, redistribute or commercially exploit the app or its content without permission; bypass subscription checks; interfere with the app or its providers; introduce malicious code; or use the app unlawfully. You must not reverse engineer the app except to the extent applicable law permits it. These restrictions do not limit statutory rights that cannot be excluded.

Content may refer to aviation, mental-health or research sources. Such references do not imply that those organizations endorse CalmSky. Third-party materials and linked services remain subject to their own rights and terms.

05Subscriptions and billing

CalmSky Pro may be offered on monthly or yearly subscription plans. A plan is available for purchase only when presented through the relevant store purchase flow. The price, currency, billing period, applicable taxes and any offer conditions are shown before you confirm. No free trial or other promotion applies unless expressly offered at checkout.

Production purchases are billed by Apple App Store on iOS or Google Play on Android. RevenueCat manages the purchase interface and subscription access. We do not collect your payment card or bank details. Any test purchase flow is for testing; it does not establish production pricing or commercial availability.

If the plan you choose renews automatically, it will renew for the stated period and at the applicable price unless you cancel before the renewal deadline shown by the store. Your store account is charged under that store’s billing rules. Review the purchase confirmation and manage renewal through the store that billed you.

You can cancel renewal in your Apple or Google Play subscription settings. Uninstalling CalmSky, stopping use or requesting data deletion does not cancel a subscription. Cancellation normally stops future renewals while access continues through the period already paid for, subject to refunds and the store’s applicable rules.

Use the app’s restore-purchase option, where available, with the store account used for the original purchase. Restore and access verification may require an internet connection. Because CalmSky has no separate account system, do not assume that a purchase transfers between Apple and Google Play. If access is missing, contact support with a transaction reference, without sending payment card details.

Changes to subscription prices or billing terms will follow applicable law and the relevant store’s notification and consent rules. You can cancel before a change takes effect. We will not impose an undisclosed charge through these Terms.

06Refunds and consumer rights

For a store-billed purchase, use that store’s refund process or contact CalmSky support for help. Refund eligibility depends on applicable law and the store’s rules. Store procedures do not remove rights you have against us under mandatory consumer law, including remedies for digital content or services that are not supplied or do not conform to the contract.

If you are an EU or EEA consumer, you may have a 14-day right to withdraw from a distance contract. For digital content supplied immediately, that right may be lost only where the legal conditions are met, including your prior express consent to begin supply and acknowledgment that you lose the right. Different rules can apply to services. These Terms alone do not obtain that consent or waive a statutory withdrawal right. Where a right applies, you may notify us at the support email using an unequivocal statement.

07Availability and changes to CalmSky

We may provide updates, correct content and change the app to maintain compatibility, address security or legal requirements, or improve its operation. We do not promise uninterrupted access or compatibility with every device. Keep the app and your device software updated where needed to use the service safely.

If we materially change or discontinue a paid feature during a paid period, we will provide notice and any remedy required by law. Changes do not override features promised at purchase or mandatory rights.

08Responsibility and limitations

You are responsible for using CalmSky appropriately and following the safety guidance in these Terms. Educational content may contain errors or become outdated. We do not promise a particular wellbeing result or warrant that content addresses your individual circumstances.

To the extent permitted by law, we are not responsible for losses caused by misuse or third-party systems outside our reasonable control. This does not excuse our own legal or contractual duties. Nothing limits non-excludable liability, including for fraud, intentional misconduct, gross negligence, or death or personal injury where protected by law. Mandatory consumer guarantees remain in force.

09Ending use and changes to these Terms

You may stop using CalmSky at any time; cancel subscriptions separately. For a material breach, we may terminate your license where law permits, with notice and an opportunity to remedy the breach where appropriate. CalmSky has no account-suspension system. Mandatory rights remain protected.

We may revise these Terms for app, billing or legal changes. We will show the effective date, give appropriate notice of material changes and obtain agreement where required. Changes will not remove accrued rights. If you disagree, stop using the app and manage your subscription before renewal.

10Privacy and disputes

The separate CalmSky Privacy Policy explains how subscription data and support correspondence are handled and how to exercise privacy rights. It is not blanket consent to data processing.

Latvian law governs these Terms, without depriving consumers of applicable mandatory protections in their country of habitual residence. Disputes may be brought before any court competent under applicable law; no exclusive Latvian jurisdiction or mandatory arbitration is required. Raise concerns at calmsky.support@topporation.com.
